General Terms and Conditions of Sale, Payment and Delivery

  1. General information

The General Conditions of Sale, Payment and Delivery ("GCSD") shall be sent to the customer together with our price lists and product catalogues. With his order, the customer acknowledges the application of these General Terms and Conditions of Sale and Delivery. Any other terms and conditions of the Customer, even on order forms, which deviate from these General Terms and Conditions of Sale, Payment and Delivery, shall only be legally binding for us if we have expressly agreed to them.

  1. Guarantee

Defective products will be replaced free of charge within the statutory warranty periods if they are defective in material or manufacturing. Further claims of the customer for cancellation of the contract, reduction of the purchase price or compensation are excluded. No compensation will be paid for natural wear and tear or for products damaged by incorrect handling. The costs for the delivery of the product complained about, including the material samples, shall be borne by the customer. If we consider the defects complained about to be justified, we will send replacement goods at our expense.

  1. Delivery times, delay in delivery

The agreed delivery times are adhered to whenever possible. However, they are not binding. Part and subsequent deliveries are possible. In the event of non-compliance with the agreed delivery times, the purchaser cannot claim damages under any circumstances. Orders and subsequent deliveries can only be cancelled due to non-compliance with the delivery time if the purchaser has pointed out in writing that the delivery time will be exceeded and a reasonable period of grace set in writing has elapsed.

  1. Delivery

Deliveries are made exclusively in Switzerland. The delivery success free of charge.

  1. Subsequent delivery

Products that are not in stock or not available at short notice will be delivered free of charge after receipt. We reserve the right of subsequent delivery together with a following order, subsequent deliveries will be made at the prices valid on the day of order. There is no obligation for subsequent delivery for products that are no longer in stock.

  1. Retention of title

We reserve title to the delivered items until the purchase price has been paid in full. The purchaser is obliged to take the measures necessary to protect our property.

  1. Complaints

Deliveries must be checked by the purchaser immediately after receipt and complaints regarding quantity, price or quality must be reported to us in writing within 8 days of receipt of the goods. Defects acknowledged by us shall be settled at our discretion either by repair, replacement, rescission or reduction. Further claims of the purchaser, in particular for damages due to non-fulfilment or for consequential damages, are excluded.

  1. Returned goods

Ordered and correctly delivered goods shall only be accepted as returned goods if we have given our prior written consent to their return. The return must be made with the invoice number and date. The costs incurred by the approved return shipment shall be borne by the return sender. The sender shall also bear the risk for the return shipment.

  1. Terms of payment

We only accept the payment options offered in the shop.

  1. Dimensions and illustrations

The information, drawings, illustrations, technical data, descriptions of weight, dimensions and contained in brochures, catalogues, circulars, advertisements, price lists or in the documents belonging to the offer are not binding unless they are expressly designated by us as binding. We reserve the right to make changes without prior notice. The texts, pictures and drawings contained in our catalogue are subject to copyright protection. Reprinting (even in extracts) is only permitted with our written permission.

  1. Place of performance and place of jurisdiction

Place of performance and jurisdiction is in any case Uster ZH. However, we are also entitled to sue the customer at the court having jurisdiction for his commercial branch.
